Ontario’s Special Investigations Unit has determined there is no basis for proceeding with charges after OPP officers arrested a man in North Bay in late March.

The SIU says officers approached a 38 year old man after he left a Percy Street residence and following a brief struggle on the ground the man was handcuffed and taken into custody.

The following morning he was taken to hospital where he was diagnosed with a broken clavicle.

The SIU report points out the officers had reason to believe the complainant was in possession of a handgun.

Given that context, the report says the officers were within their rights to immediately neutralize the threat.
